1. Acceptance of Terms

By creating an account or using DevorAI ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Platform. These Terms constitute a legally binding agreement between you and DevorAI ("we", "our", "us").

2. Description of Service

DevorAI is a marketing intelligence platform that provides: AI-powered analysis of digital advertising campaigns, optimization recommendations for Google Ads and other advertising platforms, performance dashboards and reporting tools, automated monitoring and alerting for campaign performance, and an AI assistant (DevorA) for natural-language interaction with your advertising data.

Our platform integrates with third-party advertising services (such as Google Ads) through their official APIs. We provide recommendations and analytics but do not guarantee specific advertising results or performance improvements.

3. Account Registration

To use DevorAI, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

You must be at least 18 years old to create an account. By registering, you represent that you have the legal authority to bind yourself (or your organization) to these Terms.

4. Google Ads Integration

When you connect your Google Ads account to DevorAI, you authorize us to access your Google Ads data through the Google Ads API in accordance with Google's Terms of Service and API policies. You understand and agree that:

We access your Google Ads data in read-only mode for analytics purposes. Any modifications to your Google Ads account (such as bid adjustments, budget changes, or keyword modifications) require your explicit approval through our Approvals system before execution. You retain full ownership of your Google Ads data at all times. You can revoke our access to your Google Ads account at any time through your Google Account settings or through our platform. Our use of Google Ads data complies with the Google API Services User Data Policy, including the Limited Use requirements.

5. AI-Generated Recommendations

DevorAI uses artificial intelligence to generate optimization recommendations for your advertising campaigns. You acknowledge that: AI recommendations are suggestions based on data analysis and are not guaranteed to produce specific results. You are solely responsible for reviewing and approving any changes to your advertising accounts. Past performance data used in our analysis does not guarantee future results. We are not responsible for any losses resulting from actions taken based on our recommendations.

6. Subscription and Billing

DevorAI offers subscription-based access to its services. By subscribing, you agree to: pay the applicable subscription fees as displayed at the time of purchase, provide accurate billing information, and authorize recurring charges for your chosen billing cycle. Subscription fees are processed securely through Stripe. We do not store your credit card information on our servers.

You may cancel your subscription at any time. Upon cancellation, you will retain access to your current billing period. Refunds are handled on a case-by-case basis and are not guaranteed.

7. Acceptable Use

You agree not to:

Use DevorAI for any illegal or unauthorized purpose. Attempt to gain unauthorized access to our systems or other users' accounts. Interfere with or disrupt the Platform's infrastructure. Reverse engineer, decompile, or disassemble any part of the Platform. Use automated tools (bots, scrapers) to access the Platform without our written consent. Share your account credentials with unauthorized third parties. Use the Platform to manage advertising campaigns that promote illegal products or services.

8. Intellectual Property

The DevorAI platform, including its software, design, logos, AI models, and documentation, is owned by DevorAI and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Platform for its intended purpose during your active subscription.

You retain ownership of all data you upload or connect to the Platform, including your advertising account data. We do not claim ownership of your data.

9. Service Availability

We strive to maintain high availability of our Platform but do not guarantee uninterrupted access. We may temporarily suspend the service for maintenance, updates, or security reasons. We are not liable for any losses caused by service interruptions or downtime.

10. Limitation of Liability

To the maximum extent permitted by law, DevorAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of profits, revenue, or data, advertising performance losses, business interruption, or any damages arising from your use of AI-generated recommendations.

Our total liability for any claims arising from these Terms or your use of the Platform shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless DevorAI and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising from: your use of the Platform, your violation of these Terms, your violation of any third-party rights, or any content you submit through the Platform.

12. Termination

We may suspend or terminate your account if you violate these Terms or engage in any activity that may harm the Platform or other users. You may terminate your account at any time by contacting us. Upon termination, your right to access the Platform ceases immediately, and we will delete your data in accordance with our Privacy Policy.

13. Governing Law

These Terms are governed by the laws of the Federative Republic of Brazil. Any disputes arising from these Terms or your use of the Platform shall be submitted to the courts of Curitiba, Paraná, Brazil.

14. Changes to These Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Platform after such changes constitutes acceptance of the updated Terms.
